Terms and Conditions

1. Definitions

In these Terms and Conditions:

"Mint," "we," "us," and "our" means the provider and administrator of the Mint Care+ Protection Plan.

"Customer," "you," and "your" means the original purchaser of the Protection Plan.

"Protection Plan" or "Plan" means the Mint Care+ Protection Plan purchased in connection with an eligible device sold by Mint.

"Covered Device" means the single eligible device identified on your order confirmation or order summary for which the Plan was purchased.

"Purchase Date" means the date on which the Covered Device and the Plan were purchased.

"Coverage Term" means the twelve (12) month period beginning on the Purchase Date, unless the Plan is cancelled earlier in accordance with these Terms and Conditions.

"Approved Claim" means a claim that has been reviewed and accepted by Mint under these Terms and Conditions.

"Deductible" means the amount payable by you in connection with an Approved Claim, based on the original pre-tax purchase price of the Covered Device and whether the claim is resolved by repair or replacement.

"Replacement Value" means the original pre-tax purchase price paid for the Covered Device.

"Order Summary" means the written or electronic record confirming your purchase of the Covered Device and the Plan.

2. The Plan

Mint Care+ is an optional protection plan that provides limited coverage for one (1) Approved Claim during the Coverage Term, subject to these Terms and Conditions.

The Plan applies only to the Covered Device. It is non-transferable and may only be used by the original purchaser.

The Plan does not replace any manufacturer warranty that may apply to the Covered Device. Where an issue is covered by an applicable manufacturer warranty, manufacturer repair program, or manufacturer recall, Mint may require you to first pursue that available coverage.

Any replacement device provided under this Plan is not covered under the original Plan and will not receive continuing protection under Mint Care+ unless expressly stated otherwise by Mint in writing.

Carrier Compatibility and Network Restrictions: Devices sold by Mint are unlocked where applicable; however, Mint does not guarantee compatibility with all carriers or networks worldwide. Compatibility limitations are not considered defects and are not covered under this Plan.

3. Coverage Term

Coverage begins on the Purchase Date and continues for twelve (12) months unless cancelled earlier in accordance with these Terms and Conditions.

Coverage ends immediately upon the earliest of:

  1. expiry of the Coverage Term

  2. completion of one (1) Approved Claim, whether by repair, replacement, store credit, or other settlement

  3. cancellation of the Plan by you or by Mint in accordance with these Terms and Conditions

4. What Is Covered

Subject to these Terms and Conditions, the Plan covers one (1) Approved Claim for the Covered Device during the Coverage Term where the damage or failure results from:

  1. mechanical or electrical failure arising from normal use

  2. functional failure affecting the ordinary operation of the Covered Device

  3. accidental damage, including accidental screen damage

  4. accidental liquid damage

  5. battery failure, as further described below

Battery Coverage: The Covered Device may contain a pre-owned battery. Battery health and capacity will vary based on prior use, and no specific percentage is guaranteed at the time of purchase. Normal wear, reduced capacity, and expected performance decline are not considered defects and are not covered. Coverage applies only where the battery exhibits abnormal failure, such as an inability to hold a charge or function within reasonable operational standards.

Display Coverage: Display issues may be eligible for coverage only where they result from a sudden and verifiable functional failure. Conditions resulting from normal use over time, including burn-in, image retention, or discolouration, are not covered.

For an Approved Claim, Mint may, at its sole discretion:

  1. repair the Covered Device

  2. replace the Covered Device with a device of like kind, comparable model, similar condition, and equivalent functionality, subject to availability

  3. provide store credit or another settlement option not exceeding the Replacement Value less the applicable Deductible

Coverage includes eligible parts, labour, and standard return shipping costs associated with an Approved Claim within Canada.

5. What Is Not Covered

The Plan does not cover:

  1. loss, theft, or unexplained disappearance of the Covered Device

  2. Intentional damage, misuse, reckless handling, or neglect. Accidental damage refers to sudden and unintentional events, such as drops or liquid spills. Damage resulting from repeated stress, improper handling, exposure to harsh conditions, or failure to exercise reasonable care may be considered misuse or neglect and is not covered.

  3. cosmetic damage that does not affect functionality, including scratches, dents, scuffs, finish wear, or discoloration

  4. Pre-existing conditions. Any damage or condition identified prior to the Purchase Date is considered pre-existing and is not eligible for claims. Device condition may be documented at the time of sale through inspection or recorded device details.

  5. unauthorized repair attempts, opening of the device by unauthorized persons, tampering, modification, jailbreak, software alteration, or installation of non-approved parts

  6. damage caused by failure to follow manufacturer recommendations, instructions, or ordinary care requirements

  7. damage caused by abnormal handling or use inconsistent with the intended purpose of the Covered Device

  8. damage resulting from fire, flood, earthquake, storm, power surge, or other external events beyond ordinary accidental handling

  9. manufacturer defects, recalls, or failures already covered by an applicable manufacturer warranty, manufacturer repair program, or recall program

  10. any device with an altered, removed, defaced, or mismatched serial number, IMEI, or other identifying number

  11. No fault found or unverifiable issues. If no defect or issue is identified upon inspection, the claim may be denied and the device returned. Shipping or diagnostic fees may apply.

  12. software issues, data corruption, operating system issues, malware, viruses, or password-related issues

  13. Account Locks and Security Restrictions. Devices that are locked with an Apple ID (iCloud), Google account (FRP), passcode, or any other security feature that prevents access, inspection, repair, or reset are not eligible for service under this Plan. It is the customer’s responsibility to ensure that all accounts are removed and the device is fully unlocked prior to submitting a claim. Claims will be denied if the device cannot be accessed or verified.

  14. loss of data, loss of business, loss of profits, loss of use, or any indirect, incidental, or consequential loss

  15. accessories or items not forming part of the original Covered Device, including chargers, cables, adapters, cases, screen protectors, SIM cards, memory cards, or earphones

  16. consumable items, except as expressly covered under abnormal battery failure

  17. damage occurring during shipping not arranged by Mint

  18. fraudulent, misleading, or dishonest claims or purchases

  19. any replacement device or repaired device after the Approved Claim has been completed

Specific Damage Clarifications:

  • Liquid damage includes moisture exposure in any form, including corrosion or residue in charging ports or internal components.

  • Broken or cracked camera lenses are considered accidental damage and are covered only where no signs of misuse or excessive force are present.

  • Screen burn-in, image retention, ghosting, dead pixels, or discolouration caused by prolonged use, static images, or normal wear over time are not covered. These conditions are considered gradual degradation and not a defect.

6. Claim Limit

The Plan provides coverage for one (1) Approved Claim only during the Coverage Term.

Once Mint has fulfilled one Approved Claim by repair, replacement, store credit, or other settlement, all obligations under the Plan are fully satisfied and the Plan terminates immediately.

Mint’s total liability under the Plan will not exceed the Replacement Value of the Covered Device, less any applicable Deductible.

7. Deductibles

Each Approved Claim is subject to the applicable Deductible, based on the original pre-tax purchase price of the Covered Device and whether the claim is resolved by repair or replacement. Deductibles are disclosed at the time of purchase, whether online or in-store, and must be paid in full before any repair, replacement, or other settlement is completed.

8. How To Make a Claim

All claims must be submitted through Mint’s official claim portal: https://mintcanada.com/products/warranty-claim-shipping-fee

To initiate a claim, you must provide:

  • proof of purchase

  • your Order Summary or order number

  • the serial number or IMEI of the Covered Device

  • a description of the issue or damage

  • photographs, video, diagnostic information, or other evidence reasonably necessary to evaluate the claim

Device Unlocking Requirement: The device must be fully unlocked prior to submission. All user accounts (including Apple ID and Google accounts), passcodes, and security locks must be removed before submitting a claim. Devices that remain locked or inaccessible will not be processed and may be returned at the customer’s expense. See Section 5(m) for full details.

Claim Processing and Shipping Fee: A standard claim processing and shipping fee of $9.99 plus applicable taxes applies within Canada and must be paid at the time of submission through the claim portal. This fee is non-refundable once the claim process has been initiated.

Shipping to Mint: The customer is responsible for all costs associated with shipping the Covered Device to Mint for inspection and service.

Return Shipping: For approved claims within Canada, Mint will cover standard return shipping. If a claim is denied or no repair or replacement is completed, additional shipping charges may apply.

International Shipping: For devices located outside of Canada, the customer is solely responsible for all shipping costs, duties, taxes, and logistics required to return the device to Mint and to receive it back. Mint does not cover international shipping under any circumstances.

Estimated Timelines: Claim review typically takes 2–5 business days. Repairs generally take 3–7 business days, and replacements may take 5–10 business days depending on availability. These timelines are estimates only and are not guaranteed.

A claim is not considered submitted until all required information and applicable fees have been received.

You must cooperate fully in the claims process and provide accurate, complete, and truthful information. Failure to provide requested information, failure to return the Covered Device when requested, or submission of false, incomplete, or misleading information may result in denial of the claim.

9. Inspection, Repair, and Replacement

All claims are subject to review and approval by Mint.

Mint reserves the right to refuse inspection, repair, or replacement if the device is locked, inaccessible, or cannot be reset due to active security features, including Apple ID, Google account protection, or passcodes. See Section 5(m) and Section 8 for unlocking requirements.

Mint reserves the right, at its sole discretion, to determine:

  1. whether the claim is eligible for coverage

  2. whether the Covered Device will be repaired or replaced

  3. the appropriate repair method

  4. whether a replacement, store credit, or alternate settlement is appropriate

Repairs may be completed using new, refurbished, reconditioned, or non-original parts of like kind and quality that meet reasonable performance standards.

Replacement Standard: If Mint replaces the Covered Device, the replacement may be a refurbished device or a device of comparable model, condition, and functionality. Battery performance will meet reasonable operational standards (generally 80% capacity or equivalent). A replacement device is not guaranteed to be new, and exact colour, packaging, and accessories are not guaranteed.

Any Covered Device or component replaced under the Plan becomes the property of Mint, where permitted by law.

Loaner Devices: Mint does not provide temporary or loaner devices during the claim process.

10. Data and Privacy

You are solely responsible for backing up all data, removing confidential information, signing out of accounts, and disabling security locks before sending the Covered Device for inspection, repair, or replacement.

Mint is not responsible for any loss of data, software, applications, media, contacts, passwords, or personal information.

Any repair or replacement service may result in deletion or loss of data. You accept this risk by submitting a claim.

11. Cancellation by You

You may cancel the Plan within thirty (30) days of the Purchase Date for a full refund, provided that no claim has been made.

If you cancel the Plan after thirty (30) days from the Purchase Date and no claim has been made, you may be entitled to a pro-rated refund for the unused portion of the Coverage Term.

No refund will be provided if an Approved Claim has been made, paid, or fulfilled under the Plan.

Requests for cancellation must be submitted through Mint’s customer support channel or any cancellation method made available by Mint.

12. Cancellation by Mint

Mint may cancel the Plan immediately, or deny coverage under the Plan, if:

  1. you fail to pay for the Plan

  2. the Plan was purchased through fraud or material misrepresentation

  3. a claim is fraudulent, abusive, dishonest, or materially misleading

  4. the Covered Device is found to be ineligible for coverage

  5. you fail to cooperate reasonably in the claims process

If Mint cancels the Plan for a reason other than fraud, abuse, or material misrepresentation, Mint may provide a pro-rated refund for the unused portion of the Coverage Term unless a claim has already been fulfilled.

13. Fraud and Misrepresentation

Mint may deny any claim and cancel the Plan if Mint reasonably determines that:

  1. the claim is fraudulent

  2. the Covered Device or its condition was misrepresented

  3. the damage was intentional

  4. the claim includes false, incomplete, or misleading information

  5. the Plan was purchased or used in a manner inconsistent with these Terms and Conditions

Mint reserves all rights and remedies available at law in cases of suspected fraud or abuse.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Mint will not be liable for any indirect, incidental, special, exemplary, or consequential damages, including loss of data, loss of revenue, loss of profits, loss of use, business interruption, or any other economic loss arising from or related to the Plan, the Covered Device, or any repair or replacement.

Mint’s total liability under the Plan will not exceed the Replacement Value of the Covered Device, less any applicable Deductible.

Nothing in these Terms and Conditions limits any rights that cannot be excluded under applicable consumer protection law.

15. Non-Transferability

The Plan is personal to the original purchaser and applies only to the Covered Device identified at the time of purchase.

The Plan may not be assigned, transferred, sold, or otherwise passed to any other person or to any replacement device.

16. Changes to the Plan

Mint may update these Terms and Conditions from time to time for future sales of the Plan.

The version of the Terms and Conditions in effect on the Purchase Date will apply to your Plan unless a change is required by law.

17. Entire Agreement

These Terms and Conditions, together with the Order Summary and any documents expressly incorporated by reference, form the entire agreement between you and Mint regarding the Plan.

No verbal statement, advertising language, or prior communication will alter these Terms and Conditions unless confirmed by Mint in writing.

18. Governing Law

These Terms and Conditions are governed by the laws applicable in the province or territory and country in which the Plan is sold, subject to any mandatory consumer protection rights that apply in your jurisdiction.
